There has been an ongoing saga since the introduction of Tribunal fees with the union, UNISON valiantly seeking to argue that the fees regime was unlawful and prevented access to justice.
On 26th July the Supreme Court agreed and have quashed Tribunal fees.
Whether or not the Government will seek to introduce some kind of fee regime in another way will remain to be seen. Until then though, we shall be returning to the days when anyone can bring a claim relating to their employment without having to stump up the potentially prohibitive fees.
Some employers will be frustrated by this decision as we fully expect to see an increase in Employment Tribunal claims back up to previous levels with the “have a go” litigants once again trying their luck.
