The School Governance (Constitution and Federations) (England) (Amendment) Regulations 2016 (the Regulations) were laid before Parliament on 25 February 2016.
The Regulations amend both the School Governance (Constitution) (England) Regulations 2012 and the School Governance (Federations) (England) Regulations 2012.
In summary, the new Regulations provide that:
- From 18 March 2016, if a governor at a maintained school does not hold an enhanced criminal record certificate, the governing body must apply for one by 1 September 2016. If the governor is elected or appointed on or after 1 April 2016, the governing body must apply within 21 of days of appointment.
- From 1 September 2016, the governing body of every federation must include two parent governors (either elected by parents or appointed by the governing body). This differs from the stance taken by the Department of Education in the recent White Paper in relation to academy trusts, which states that there will no longer be a requirement for parents to be on governing boards and that appointments should be based entirely on skill set.
